Raya AI TOS

These Terms of Service are an agreement between you and Cleverly Genius LLC, a Mississippi limited liability company based in Rankin County, Mississippi ("Cleverly Genius," "we," "us"). They apply when you use Raya AI or buy an AI Package or a Credit Booster. All purchases are final. There are no refunds. By checking the box to agree, or by buying or using Raya AI, you accept these terms.

1. What Raya AI Is

Raya AI is the artificial intelligence service built into Clever Members. It can help you write and edit content, create images and other media, build and change pages, and answer questions about your website. Raya AI runs on credits: each request uses a number of credits based on the kind and size of the work.

2. AI Packages

• An AI Package is a subscription that adds a set number of credits to your website each billing period, monthly or yearly as shown when you subscribed.
• Your subscription renews automatically until you cancel it. You can cancel at any time; the package stays active until the end of the period you already paid for.
• Credits included in a package [expire at the end of each billing period and do not carry over / carry over while the subscription stays active].
• We may change package prices or the number of credits included with at least 30 days' notice. Changes apply starting with your next billing period after the notice.

3. Credit Boosters

• A Credit Booster is a one-time purchase of extra credits for your website.
• Booster credits are added to your website right after payment.
• Credits are tied to the website they were bought for. They cannot be moved to another website, shared, sold, or exchanged for cash.

4. No Refunds

All payments for Raya AI, AI Packages, and Credit Boosters are final and non-refundable. This includes:

• Credits that are unused, used up, or have expired
• AI results you are not happy with
• A subscription you cancel partway through a billing period
• Credits lost when a website or account is closed, moved, or ended for breaking these terms

If a technical error on our side charges you for credits that were never added to your website, contact us and we will add the missing credits.

5. AI Results

Raya AI creates content automatically, and it can make mistakes. Results may be inaccurate, incomplete, or similar to content made for others.

• You are responsible for reviewing everything Raya AI creates before you publish or use it.
• Raya AI is not a lawyer, accountant, doctor, or other licensed professional, and its results are not professional advice.
• As between you and Cleverly Genius, you own the content Raya AI creates for your website, to the extent the law allows.
• Credits are used when a request is processed, even if you choose not to use the result.

6. Acceptable Use

You agree not to use Raya AI to:

• Create content that is illegal, hateful, harassing, sexually explicit, or violent
• Create false or misleading information meant to deceive people
• Copy or infringe someone else's copyright, trademark, or likeness
• Create spam or malicious code
• Try to get around credit limits, share credits, or resell Raya AI

We may suspend Raya AI on a website that breaks these rules. Credits lost because of a suspension are not refunded.

7. Your Privacy

Cleverly Genius LLC does not sell, rent, or trade customer information to anyone. We do everything we reasonably can to protect your privacy. We keep only what we need to run Raya AI and bill you, such as your name, email address, website address, purchases, and credit usage. We do not use your website's content for anything other than completing your requests.

8. No Warranty

Raya AI is provided "as is." We do not promise that it will always be available, error-free, or produce any particular result.

9. Limit of Liability

To the fullest extent allowed by law, Cleverly Genius's total liability for any claim related to Raya AI, AI Packages, or Credit Boosters is limited to the amount you paid for them in the 3 months before the claim. We are not responsible for lost profits, lost data, or other indirect damages, or for anything you publish using Raya AI.

10. Ending Service

You may stop using Raya AI or cancel an AI Package at any time. We may suspend or end Raya AI for a website that breaks these terms. We may also discontinue Raya AI; if we do, we will give notice, stop renewals, and keep remaining credits usable until the service ends.

11. Changes to These Terms

We may update these terms from time to time. The new version will show a new effective date, and you may be asked to agree to it before your next purchase.

12. Governing Law

These terms are governed by the laws of the State of Mississippi. Any dispute will be handled in the state or federal courts located in or serving Rankin County, Mississippi.
