These terms govern your use of Clever Church Books, a Clever Members companion plugin from Cleverly Genius LLC for church bookkeeping: profiles, contributions, refunds, expenses, church account balances, reports, contribution letters and envelopes.

1. Agreement

Clever Church Books is provided by Cleverly Genius LLC, a Mississippi limited liability company ("Cleverly Genius," "we," "us"). "You" means the church or organization whose website Clever Church Books is installed on, and everyone it allows to use it.

By installing, subscribing to, starting a free trial of, or using Clever Church Books, you agree to these terms. If you don't agree, don't install or use it. These terms add to the terms for Clever Members; where they differ, these terms govern Clever Church Books.

You must be at least 18. If you accept for a church or other organization, you confirm you are authorized to bind it.

2. The service

Clever Church Books runs inside Clever Members on your website. It lets you:

• keep profiles of members, visitors, families, businesses and the church's own accounts;
• record contributions, refunds and expenses, split across church accounts, with running balances and transaction labels;
• run financial and profile reports, and print contribution letters and envelopes; and
• choose which roles may use each part.

If you turn it on, each contribution, refund and expense is also copied into Clever Members Accounting. Copies are changed or removed when the transaction is changed or deleted in Clever Church Books.

We may add, change or remove features over time. We will tell you before removing a feature you rely on, where we reasonably can.

3. Your records and your members' information

• Where it is kept: your profiles, transactions, reports and settings are stored in your website's own database, on your hosting. Cleverly Genius does not receive or keep a copy.
• You own them and are responsible for them: entering them accurately, keeping them up to date, and deciding who may see them.
• Your members' privacy: you are responsible for having permission to keep the names, addresses, giving records and other details you enter about people, for protecting them, and for your own privacy policy. Giving records are sensitive; give access only to people who need it.
• Backups: keep regular backups of your website and export your records from Settings > Plugin Settings > Clever Church Books > Database. We are not responsible for records lost through hosting problems, deleted data, or a failed update.
• Support: if you ask us for help, our staff may see your records while working on your website. We use them only for that work and keep them confidential.

4. Not accounting, tax or legal advice

Clever Church Books is a record-keeping tool. Its reports, balances, contribution letters and statements are produced from what you enter, and they are only as accurate as that information.

• It does not provide accounting, tax or legal advice, an audit, or financial statements prepared by an accountant.
• You are responsible for making sure your contribution statements and acknowledgments meet IRS and state requirements, including any wording about goods or services received, and that they are sent on time.
• Have a qualified accountant or tax professional review your records and statements when needed.

5. Roles and access

Administrators and Super Members can always use every part of Clever Church Books. You choose which other roles may use Profiles, Transactions, Transaction Labels, Reports and Envelopes, and who may change its settings.

You are responsible for who you give access to, for keeping their passwords secure, and for what they do in Clever Church Books. Remove a person's role when they no longer need access, for example when a treasurer's term ends.

6. Subscription, trial and payment

• Clever Church Books is offered through Clever Members, free or by subscription at the price shown when you get it. It is licensed to you, never sold: you cannot own it outright.
• Free trial: if a free trial is offered, each website may use it once. When the trial ends, Clever Church Books stops working unless you subscribe. Your records stay in your website's database.
• Billing: subscriptions renew automatically through PayPal for each billing period until you cancel. You can cancel at any time; it keeps working until the end of the period you paid for.
• Refunds: subscription payments already made are not refunded, except where the law requires it.
• Failed payments: if a payment fails and isn't fixed in time, Clever Church Books stops working until the subscription is renewed. Your records are kept, and come back when you renew.
• We may change the price for future billing periods. Current subscribers keep their price unless we tell them in advance.

7. Updates, support and uninstalling

• Updates are installed through Clever Members. Keep Clever Members and Clever Church Books up to date; older versions may stop working or lose features.
• Support is available through cleverlygenius.com while your subscription is active.
• Uninstalling: you can uninstall Clever Church Books in Clever Members at any time. If you tick "Delete its data," every profile, transaction, label, report and setting is permanently deleted, along with its copies in Clever Members Accounting. This cannot be undone, so export your records first.

8. Disclaimers, liability and indemnity

Suspension. We may suspend or end your access to Clever Church Books if you break these terms. Sections 3, 4, 8 and 9 continue after your use ends.

No warranty. Clever Church Books is provided "as is" and "as available." To the fullest extent the law allows, Cleverly Genius disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise it will be error-free or that its reports and balances are free of mistakes.

Limit of liability. To the fullest extent the law allows, Cleverly Genius is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost donations, tax penalties, or financial errors, including from incorrect reports, balances or statements. Our total liability for any claim about Clever Church Books is limited to the amount you paid us for it in the 12 months before the claim.

Indemnity. You agree to defend and hold harmless Cleverly Genius LLC and its owner from claims, losses and costs (including reasonable attorneys' fees) that arise from the records and personal information you keep, your use of Clever Church Books, or your breach of these terms.

9. Governing law, changes and contact

• Governing law: these terms are governed by the laws of the State of Mississippi. Any dispute will be resolved in the state or federal courts serving Rankin County, Mississippi, and you agree to their jurisdiction.
• Changes: we may update these terms. We will show the new version in Clever Members and change the date above. Continuing to use Clever Church Books after an update means you accept it; if a change requires your agreement, you will be asked before you can keep using it.
• Whole agreement: these terms, the Clever Members terms and our Privacy Policy are the whole agreement about Clever Church Books. If any part is unenforceable, the rest still applies.
