Cleverly Genius LLC collects only what it needs to provide its services, never sells personal information, and deletes your information when you ask, including any Facebook and Instagram data from Clever Social Poster.

1. Who we are and what this policy covers

Cleverly Genius LLC ("Cleverly Genius," "we," "us") is a Mississippi company that builds websites and provides marketing and technical services. We also make Clever Members, its companion plugins (including Clever Social Poster), and Raya AI.

This policy covers information we collect through cleverlygenius.com, our services, Clever Members and its companion plugins, and Raya AI. It does not cover the websites our clients run with Clever Members: each client's own privacy policy covers what their visitors enter there (see section 7).

2. Information we collect

What you give us:

Contact and business details: your name, organization, email, phone number and address.
Billing details. Payments are processed by PayPal and other payment processors; we never see or store full card numbers.
Messages, support requests and form submissions you send us.
Access you grant us to your website, hosting, domain, email or social media accounts so we can do work for you.
What you agree to: a record of when you accepted our Terms of Service.

What we collect automatically:

Basic technical details when you visit cleverlygenius.com, such as your browser type, pages visited and IP address.
For websites running Clever Members: the website's address, the Clever Members and companion plugin versions installed, and license and subscription status.
Raya AI usage, such as the number of requests and credits used.
If you connect Facebook or Instagram to Clever Social Poster, the information described in section 3.

Clever Social Poster lets a website owner connect one Facebook Page and the Instagram professional account linked to it, and schedule posts to publish there. It uses Meta Platforms, Inc.'s official Facebook Login and APIs. Cleverly Genius is not affiliated with Meta.

What we receive and keep from Meta:

The list of Facebook Pages you manage, so you can choose which Page to connect. We keep only the one you choose.
The connected Page's and Instagram account's name, ID and profile picture, so you can see which accounts are connected.
The access token Meta gives us for that Page, so we can publish the posts you schedule.
The posts you schedule (graphic, text, date and time), so we can publish them at that time.
Each post's result (published or failed, its post ID and link), so you can see it in your post history.

What we don't do:

We don't read or collect your messages, comments, followers, friends, or anyone else's information.
We use this information only to publish your posts and show their results. We don't sell it, share it with third parties, use it for advertising, or use it to train AI.
We don't post anything you haven't scheduled or approved.

Where it is kept: on Cleverly Genius's servers for cleverlygenius.com in the United States. Access tokens are stored encrypted and never sent to your website.

When it is deleted:

A post's graphic is deleted from our servers after the post is published or canceled.
Disconnecting your accounts in Clever Members (Settings > Plugin Settings > Clever Social Poster) deletes the access token and the connected accounts' details right away.
Removing Clever Social Poster from your Facebook settings (Settings & privacy > Settings > Business integrations) tells us to delete them as well.
Post history (text, dates, results and links) is kept while you subscribe, so you can see past posts, and deleted within 30 days after your subscription ends or when you ask (section 9).

4. How we use information

We use information to:

provide, support and improve our services, Clever Members, its companion plugins and Raya AI;
process payments, licenses and subscriptions;
answer questions and support requests;
send important notices about your account, billing, security and changes to our services;
keep our services and your website secure, and prevent misuse; and
meet legal, tax and accounting obligations.

We send marketing emails only if you agree to receive them, and every one has a way to unsubscribe.

We do not sell, rent or trade your personal information, and we do not share it for advertising.

We share information only as needed to provide our services, with companies that must protect it and use it only for that work:

Payment processors (such as PayPal) to take payments.
Hosting, domain and email providers that run our servers and deliver email.
Meta (Facebook and Instagram), only to publish the posts you schedule with Clever Social Poster, or when we manage your social media accounts for you.
AI providers that power Raya AI, only the content needed for each request (section 7).
Authorities, when the law requires it, or to protect our rights, our customers or the public.

If Cleverly Genius is sold or merged, information may transfer to the new owner, who must keep this policy's promises.

6. Cookies

cleverlygenius.com uses essential cookies so the site works and you can sign in, and may use basic analytics to see which pages are visited. We don't use advertising or tracking cookies. You can block or delete cookies in your browser, but some features, such as signing in, may stop working.

7. Your clients' websites and Raya AI

Websites running Clever Members. What visitors and members enter on a client's website (accounts, forms, payments, bookings and so on) is stored on that website and its hosting, not on our servers. The website owner is responsible for it and for their own privacy policy. When we design, support or maintain a client's website, our staff may see that information; we use it only for that work and keep it confidential.

Raya AI. When you use Raya AI (for example to write text or create a graphic), your request and the content needed for it are sent to our AI providers to produce the result. They may use it only to provide that result. Please don't include sensitive personal information, such as health, financial or identification details, in Raya AI requests.

8. Security and how long we keep information

Security. We use HTTPS, limit access to people who need it, store passwords and access tokens securely, and remove our access to your accounts when our work ends. No system is perfectly secure; if a breach affects your information, we will tell you promptly.

How long we keep it. We keep information while you are our customer, and afterward only as long as needed for billing, tax, legal and support purposes, then delete it. Facebook and Instagram data is kept and deleted as section 3 describes.

9. Your rights and how to request deletion

You can ask us to:

send you a copy of the personal information we hold about you;
correct it;
delete it, except what we must keep for legal, tax or billing reasons; and
stop sending you marketing emails (or use the unsubscribe link in any of them).

We will not treat you differently for using these rights.

To delete your Facebook and Instagram data (Clever Social Poster):

In Clever Members, go to Settings > Plugin Settings > Clever Social Poster and click Disconnect. This deletes the access token and connected account details right away.
Or, in Facebook, go to Settings & privacy > Settings > Business integrations and remove Clever Social Poster.
To also delete your post history and anything else we hold, use our contact form and include in the message "Delete my data" and your website's address. We will confirm and delete it within 30 days.

For any other request use our contact form. We will reply within 30 days and may ask you to confirm who you are first.

10. Children, changes and contact

Children. Our services are for businesses, organizations and adults. We don't knowingly collect information from children under 13; if we learn we have, we delete it.

Changes. When we update this policy, we post the new version here with a new date. If a change is significant, we also email our customers before it takes effect.

These terms govern your use of Clever Social Poster, a Clever Members companion plugin from Cleverly Genius LLC that schedules and publishes posts to your Facebook Page and Instagram account.

1. Agreement

Clever Social Poster is provided by Cleverly Genius LLC, a Mississippi limited liability company ("Cleverly Genius," "we," "us"). "You" means the owner of the website where Clever Social Poster is installed, and everyone that owner allows to use it.

By installing, subscribing to, starting a free trial of, or using Clever Social Poster, you agree to these terms. If you don't agree, don't install or use it. These terms add to the terms for Clever Members; where they differ, these terms govern Clever Social Poster.

You must be at least 18 and able to enter a binding contract. If you accept for a church, business or other organization, you confirm you are authorized to bind it.

2. The service

Clever Social Poster lets you create a post (a graphic and text), choose a date and time, and have it published to the one Facebook Page and one Instagram professional account connected to your website. A post can go to both, or have a separate version for each.

Approvals: you decide which roles may write posts and which may approve and schedule them. You are responsible for who you give each permission to.
Raya: if you choose, Raya can create the graphic, write the text and hashtags, or both (see section 5).
Publishing: posts are published through Cleverly Genius's servers at cleverlygenius.com using Meta's official tools for Facebook and Instagram.

We may add, change or remove features over time. We will tell you before removing a feature you rely on, where we reasonably can.

3. Connecting Facebook and Instagram

You may connect only a Facebook Page and Instagram account you own or are authorized to manage, and you confirm you have that authority.
Your use of Facebook and Instagram stays subject to Meta's own terms, policies and Community Standards. You are responsible for following them, including any Page Publishing Authorization Meta requires.
Cleverly Genius is not owned by, endorsed by or affiliated with Meta Platforms, Inc. Facebook and Instagram are Meta's trademarks.
Meta may change, limit or stop its services, posting limits or our access at any time. When that affects Clever Social Poster, we will try to restore it but cannot promise to.
You can disconnect your accounts at any time in Settings > Plugin Settings > Clever Social Poster, or remove our access in your Facebook settings. Scheduled posts that have not been published will not go out after you disconnect.

4. Your content

You own the graphics and text you post, and you are solely responsible for them, whether you, your staff or Raya created them. You give Cleverly Genius permission to store, convert (for example to the image format Instagram requires) and send your content only as needed to publish it for you.

You confirm you have the rights to everything you post, and that it does not:

infringe anyone's copyright, trademark, privacy or publicity rights;
contain anything unlawful, defamatory, harassing, hateful, sexually explicit or deceptive;
contain spam, malware or misleading links; or
break Meta's terms or policies.

We do not review posts before they are published. Approving a post in Clever Social Poster is your own review, not ours. We may remove content from our servers or stop a scheduled post if we believe it breaks these terms or the law.

5. Raya content and credits

Raya creates graphics and text automatically from what you describe. Results can be inaccurate, unsuitable, or similar to content others receive. Review and edit everything Raya creates before you schedule it.
Don't ask Raya to imitate a real person, another organization's brand or logo, or a copyrighted character, and don't use Raya to make content that section 4 does not allow.
Each graphic or text Raya creates uses your website's Raya credits, including ones you discard or ask Raya to redo. Credits are bought separately from your Clever Social Poster subscription.
Raya credits and Credit Boosters are not refundable.
Between you and Cleverly Genius, you may use what Raya creates for you as your own content, subject to these terms.

6. Scheduling and publishing

We work to publish each post at the date and time you choose, but we don't guarantee that any post will be published, published on time, or shown to your followers. A post may be delayed or fail because of Meta's systems or limits, an expired or removed connection, an image Meta won't accept, or outages at Cleverly Genius or our hosting provider.

When a post fails, Clever Social Poster shows the reason it was given and notifies the people who can approve posts. Checking that your posts went out is your responsibility. Don't rely on Clever Social Poster for anything time-critical or for emergencies.

7. Data and privacy

When you connect, we keep only what we need to publish for you: your Page's and Instagram account's name and picture, the access permission Meta gives us, the posts you schedule with their graphics, and each post's result and link.

We don't read or collect your messages, comments, followers or other people's information.
We don't sell or share this data, and we don't use it for advertising.
After a post is published, we delete our copy of its graphic. Disconnecting deletes your access permission and connection details from our systems.

8. Subscription, trial and payment

Clever Social Poster is offered by subscription through Clever Members, at the price shown when you subscribe. It is licensed to you, never sold: you cannot own it outright.
Free trial: if a free trial is offered, each website may use it once. When the trial ends, Clever Social Poster stops working and scheduled posts are not published unless you subscribe.
Billing: subscriptions renew automatically through PayPal for each billing period until you cancel. You can cancel at any time; it keeps working until the end of the period you paid for.
Refunds: subscription payments already made are not refunded, except where the law requires it.
Failed payments: if a payment fails and isn't fixed in time, Clever Social Poster stops working until the subscription is renewed.
We may change the price for future billing periods. Current subscribers keep their price unless we tell them in advance.

9. Suspension, disclaimers and liability

Suspension and ending service. We may suspend or end your access to Clever Social Poster if you break these terms, misuse Meta's services, or if Meta requires it. You may stop using it at any time by disconnecting your accounts and uninstalling it. Sections 4, 5, 9 and 10 continue after your use ends.

No warranty. Clever Social Poster and Raya are provided "as is" and "as available." To the fullest extent the law allows, Cleverly Genius disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

Limit of liability. To the fullest extent the law allows, Cleverly Genius is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, followers or reputation, including from posts that were published late, not published, or published as you scheduled them. Our total liability for any claim about Clever Social Poster is limited to the amount you paid us for it in the 12 months before the claim.

Indemnity. You agree to defend and hold harmless Cleverly Genius LLC and its owner from claims, losses and costs (including reasonable attorneys' fees) that arise from your content, your use of Clever Social Poster or Raya, or your breach of these terms or Meta's terms.

10. Governing law, changes and contact

Governing law: these terms are governed by the laws of the State of Mississippi. Any dispute will be resolved in the state or federal courts serving Rankin County, Mississippi, and you agree to their jurisdiction.
Changes: we may update these terms. We will show the new version in Clever Members and change the date above. Continuing to use Clever Social Poster after an update means you accept it; if a change requires your agreement, you will be asked before you can keep using it.
Whole agreement: these terms, the Clever Members terms and our Privacy Policy are the whole agreement about Clever Social Poster. If any part is unenforceable, the rest still applies.
